1. Who we are
These Terms govern your use of the Ventrique website and the Validate service, operated by Jaco Louw trading as Ventrique (formal CIPC registration pending). Contact: support@ventrique-za.com. By using the website or buying the Validate service, you agree to these Terms and to our Privacy Policy.
2. What Ventrique is — scope of service
Ventrique runs an AI consulting-panel and research over the idea you submit and returns an evidence-cited go/no-go assessment together with a generic, educational founder-pack draft.
Ventrique provides information and drafts. Ventrique does NOT provide legal, financial, investment, or tax advice, and is not a law firm, financial services provider, or registered tax practitioner. Any output that would apply rules to your specific facts to affect legal rights, recommend a financial product, or take a tax position is a regulated output — it is structurally gated and only delivered after review and sign-off by an appropriately licensed professional. Obtain your own independent professional advice before relying on any output for a legal, financial, investment, or tax decision.
3. The Validate offer, deposit and fees
Pricing is shown clearly at checkout. The refundable deposit is credited toward the Validate fee if you proceed. We take payment through PayFast; we do not store your full card details. The Validate service gives you an evidence-cited assessment and educational drafts — it does not guarantee any business outcome, funding, approval, or success.
4. Cancellation and cooling-off
Where an electronic transaction qualifies for a statutory cooling-off right under ECTA, or a fixed-term cancellation right under CPA section 14, you may exercise it in the manner the law prescribes. You may demand we stop direct marketing at any time (CPA s32). To cancel or exercise these rights, contact support@ventrique-za.com.
5. Fair terms
These Terms are intended to be in plain language and free of terms the Consumer Protection Act (CPA) section 48 prohibits. If any term is found unenforceable, it is severed and the rest of these Terms continue to apply.
6. Acceptable use
When using Ventrique you agree not to:
- submit content you have no right to submit, or that infringes anyone's rights;
- submit other people's personal or sensitive information unless necessary and lawful;
- attempt to manipulate, jailbreak, or inject instructions into our AI systems;
- use the service unlawfully or to generate unlawful or harmful content;
- resell, scrape, or systematically extract the service or its outputs without our consent.
We may suspend or terminate access for breach of these Terms.
7. Intellectual property
The Ventrique website, software, branding, and templates are owned by us or our licensors. You keep ownership of the idea content you submit; you grant us a limited licence to process it solely to provide the service. You may not remove proprietary notices or misrepresent the source of any deliverable.
8. Limitation of liability
To the extent the law permits (and without limiting or excluding any right you have under the CPA, or any liability the law does not allow us to exclude), the service and its outputs are provided "as is" — information and drafts only — without warranty that they are complete, accurate, or suitable to rely on without independent professional review. We are not liable for a decision you take in reliance on a self-service output without obtaining the professional advice or licensed sign-off described in section 2.
9. Privacy
Our processing of your personal information is governed by our Privacy Policy (POPIA s18 notice), which forms part of these Terms. Marketing consent is separate and optional, and never a condition of using the service.
10. Marketing claims
We describe Ventrique honestly. We do not represent that Ventrique replaces a lawyer, accountant, financial advisor, or tax practitioner, and we do not guarantee funding, approval, or success.
11. Governing law and disputes
These Terms are governed by the law of the Republic of South Africa. Please first contact support@ventrique-za.com so we can try to resolve any dispute. Nothing here limits your right to refer a consumer complaint to the National Consumer Commission or a data-protection complaint to the Information Regulator (inforegulator.org.za).
12. Changes to these Terms
We may update these Terms; the version and this page will change when we do.
